How Do I Video Interview...Candidates With a Negative Digital Footprint

How Do I Video Interview...Candidates With a Negative Digital FootprintEvery candidate comes with their own set of unique interviewing challenges. Thats why were tackling how to video interview different types of job seekers with this how to series. Today, well be talking about how to connect with job seekers with a less than ideal digital footprint.Who hasnt Googled themselves from time to time? Doing a quick Google search of a top candidates name is just second nature in todays digitally-connected world. The online presence of your top talent can certainly tell you something about the individuals personality and responsibility level. In todays world, leaving your Google results to chance just doesnt make sense. In fact, a recent article on Forbes delves into why job seekers should care about their online presence. According to stats from Comscore quoted in the article, nearly 90 percent of U.S. world wide web users visit a social media website each day. And the digital footprint lef t behind just might help you differentiate between good and bad job seekers. So once youve seen examples of a negative digital footprint, how do you address this issue in the video interview? You dont want to lose out on a great candidate because of one misplaced tweet, but you also dont want to hire someone who cant even manage their own online presence. Here are some tips for using the video interview to find out if the negative digital footprint is an accurate depiction of your candidateAddress their online presence If you were concerned by the negative picture painted by a candidates online presence, the video interview is a great place to let job seekers explain themselves. You dont want to miss out on top talent just because theyve made a mistake on social media. Still, big blunders in a candidates digital footprint need to be addressed sooner rather than later.Use the video interview as a space to air your concerns and listen to the candidates explanation. Perhaps what you saw was several years old. Maybe those pictures of your candidate at a keg fete were from college or the job seeker didnt even know they existed. The important aspect is to be honest in the video interview about what you saw and how it concerns you.Look for professionalism, and watch for defensiveness If the candidate feels cornered, they might react in a negative fashion. This is truly telling about how the job seeker will handle stressful situations or criticism of their work. Watch their body language in the video interview for signs of defensive behavior or open communication. If the candidate is honest and professional in their answers, this is a good sign. Every mistake is an opportunity for learning and growth. If the candidate takes that track, you might have a great hire on your hands. However, if the candidate gets overly defensive its likely this person would have a negative impact on your company culture.State your social media policy A candidate with a negative digital footp rint might present the perfect opportunity to get crystal clear about your companys social media policy in the workplace.Use the video interview to inform the candidate about your organizations social media dos and donts. This way you, as an interviewer, can spin a negative into a positive. You can use the candidates less-than-ideal online presence and turn it into a teachable moment. Not every candidate with a negative digital footprint should find their video resume in your email trash bin. Instead, use the video interview as a platform to address your concerns and evaluate whether this was a one-time mistake or an ongoing problem. How would you use the video interview to evaluate job seekers with a less than ideal online presence? How to quickly blow past the top 1-3% of your industry

How to quickly blow past the top 1-3% of your industryHow to quickly blow past the top 1-3% of your industryThe more successful a person becomes, the more distractions there are. The harder it is to remain focused on their core objectives. We are now living in what Harvard geschftlicher umgang Review calls, The Gig Economy, where youre essentially working for yourself as a specialist or collaborator with multiple companies or multiple projects. In the gig economy, you want to be what Kevin Harrington calls, A key person of influence, which means youre well-known in the field and get access to all the best gigs. The challenge with getting access to all the best gigs is that opportunities can be distractions. When you abflug to become successful, tons of opportunities pop-up and it can be very difficult not to chase pretty pennies or other peoples definitions of success. Whether that be making more money, having more influence, etc.Success begets success. When you develop a certain positio n and skill-level, you can get results a lot faster and easier than you initially could. Youve also undergone several quantum leaps in your psychology - allowing you less fear and apprehension about failing and trying new things.Follow Ladders on FlipboardFollow Ladders magazines on Flipboard covering Happiness, Productivity, Job Satisfaction, Neuroscience, and moreBecause youve succeeded regularly in the past, you expect to continue to succeed. Which can create an over-confidence where you pursue things you have little skill or ability in. You also lack a firm enough WHY to truly create mastery, but are often seeking faster and faster wins. Sustaining the dopamine highs of winning can confuse people.Need for achievementAccording to psychological research, fruchtwein people who are highly-driven have whats called a high need for achievement. If these people value something, they go after it with relentlessness. If you value money, fame, influence, or looking good, youll probably get it. If you value family or faith, youll probably thrive at those things. Whatever you value, youll do whatever you can to achieve in that area. The challenge is, when you become more successful you can easily come to value vaguer and vaguer notions of success, and forget the core reasons that got you excited in the first place. On top of that, developing mastery at something, or getting to a position where results become easy can be mind-numbing.Human beings adapt very quickly to their situation. Often, when a person becomes successful, they get lazy because the results can come easily. Theyve got the money, confidence, connections, skills, and resources to replicate the results that used to take faith, ingenuity, and resourcefulness. When choices start to falterThe challenge with becoming successful is that you can become apathetic and bored with where youre at. Which can dull the razors edge needed to be hungry, humble, and striving. You can begin justifying staying up later. Throwin g away your solid routines. Not setting yourself next day up for success. Planning less. Going thorough the motions more. Seeking more forms of entertainment.Personality and identity are both shaped by decisions. As is confidence.Consequently, if a person whose been successful in the past begins making less quality decisions consistently, their confidence will subtly drop, even if subconsciously. They may not even see it happening, because the changes will be so minor day-to-day. Also, they probably wont discern their inevitable plummet because theyll be succeeding in visual areas. Yet internally theyre falling apart.Author Molly Bloom calls this the obsession to seek increasingly unsustainable dopamine hits. This is why you can quickly blow past the bestWherever you currently are - you can blow past the best of the best in your industry. The 1%.Why?Because theyre dealing with everything Ive just detailed above.People change over time.People get bored. They lose track of what they wa nt and why. They need new frontiers and challenges. They get distracted by shiny objects. They get distracted by all the noise and other forms of perceived success and they stop polishing their craft. In basketball terms, they stop practicing their lay-ups and free-throws.You may not notice a drop in their performance over the first year or two, but eventually it catches up. And it catches up VERY fast when it does.Ive witnessed this in some of the people I once admired. Those people who sit atop my field when it comes to influence and mastery. Ive watched some of my favorite authors and thinkers completely lose focus on what they were about and to start playing it safe in the content they produced.I could tell they started getting lost and numbed and confused by everything going on around them. They stopped pushing themselves. They stopped making increasingly better and better decisions. At some point, they became satisfied enough with their results that they allowed goal-defeating behav ior to creep-in. And it began to creep-in consistently enough to erode their confidence.Heres how to crush it in the gig economyAccording to the research cited in the Harvard Business Review article referenced above, heres how to thrive in the gig economykeeping a schedulefollowing a to-do listbeginning the day with the most challenging and creative workoptimizing for sleepmeditationnutritionexerciseI can attest to this. The best way to succeed in an economy where youre rewarded by the quality of your results and thinking - not by the amount of time you work - is by optimizing your time and energy. You need to do your best work when you work best. This means you must make hard decisions. You have to miss certain things that the masses wont be willing to miss - like staying up late on your favorite mind-numbing distraction.Youll need to optimize your evenings for sleep and recovery. Youll need to wake up recovered, get clarity, and produce your best work before the day takes over.I f you continually push yourself to expand and grow, youll get better and better opportunities. All the best gigs will come your way.You should absolutely take those. Theyll continue to push you further in your growth and creativity. You should collaborate with your mentors and heroes. But you also need to continue producing at the same volume and quality of your own work. This is the tricky part. When you start growing your platform, influence, and geschftsleben - you still need to maintain the mindset of that scrappy creative while grappling the success youre achieving. While everyone else in the top 1-3% are getting fatter and lazier, youre getting leaner and remaining just as humble and disciplined as you were when you first started.Youre still connecting and collaborating. Youre still expanding your network and business skills. But you will never forget about why youre really doing this. You absolutely do have a need for achievement. And you know which direction you want to point it toward. Youre not going to allow yourself to get lost in other peoples perceptions of success, no matter how lucrative, sexy, or easy.Youre going to stay your course and achieve your mission. And this is whats going to separate you from the rest. This is how youre going to blow past the legends. At some point, they lose their hunger and drive. At some point, they started pursuing first place in the finish lines. They stop pushing their creative boundaries. They stop learning as much and became comfortable with the level of expertise they had. They become more scattered in their thinking and priorities - which is almost impossible not to do. Because the more successful you become, the more complex your work and life becomes.Yet, you can remain clear as things become complex by remaining true to what achievements matter most to you. And by continually pushing your creative boundaries. By continually producing on your own while youre growing a business or collaborating with others.Youve got this. You can blow-past the elite. Just dont lose yourself on the way up. Keep doing what youre doing. Maintain that same level of discipline and productivity. Keep producing. Keep creating. Stick with your process. Its killing it.Listen to your body.Listen to your soul. This article first appeared on Medium. You might also enjoyNew neuroscience reveals 4 rituals that will make you happyStrangers know your social class in the first seven words you say, study finds10 lessons from Benjamin Franklins daily schedule that will double your productivityThe worst mistakes you can make in an interview, according to 12 CEOs10 habits of mentally strong people

5 Ways to Beat Burnout at Work

5 Ways to Beat Burnout at Work 5 Ways to Beat Burnout at Work Some projects can really take it out of you. You’ve been working for 10+ hours a day, brainstorming new ideas as you brush your teeth in the morning, and thinking about the best way to pitch as you climb into bed at night. Your focus, creativity, and problem-solving abilities have been put to the test- for hours, days, and weeks on end.And now, it’s time for a vacation. Well, that is, if you define vacation as a Sunday afternoon to yourself to do laundry and grocery shop, before it’s back to the office Monday morning.Unfortunately, you don’t always get a break when you need it most. So, how do you stay sane at work when you’re coming off of a big project or a particularly stressful season? Battle your burnout on those rough days (or weeks) with these five simple ideas.1. Take a Lunch Break (Or Better Yet, a Walk)When you’re exhausted, it can be tempting to just stay at your desk through lunch or spend that extra 10 minutes you have browsing Facebook. But save being glued to your computer screen for the times when it’s unavoidable- and make yourself get a change of scenery. I promise, it’ll be much more refreshing, and it will probably even make you more productive when you get back to your seat.Better yet, if you have some degree of flexibility in your hours, take advantage of it. Can you work from home one day a week, or from a coffee shop? At my last job, I found a lunchtime yoga class and negotiated coming in a half hour earlier two days each week to attend it. It helped me get physically out of the office, not to mention stay sane- and my zen attitude totally benefited the office.2. Manage UpYou’re likely facing burnout because you’re no slacker- and you’ve been putting 110% effort in, all day, every day.But does your supervisor know that? Hopefully, the answer is yes, but if not, this is a good time to draft up a recap of the project you’ve been working on, outlining your work and results. Making sure your boss stays apprised of you r innovation and extra hours will pay dividends in future evaluations (and may even land you a morning off). Also make sure you make notes for your own use, so you can update your resume or discuss your work in future interviews. Plus, just seeing all of your accomplishments on paper is a great way to boost your mood and remind you of the great work you’ve done.3. Contextualize Your WorkWhen you’re burned out, every part of the daily grind can seem unbearable, but remember that there are (hopefully) things you really like about your job. Whether it’s research, design, or working with clients that really makes your day, allotting some of your hours to your favorite parts of the job, particularly the stuff you haven’t had time to do recently, will give you the “it’s all worth it” feeling. Not loving any aspects of your workload right now? Step back and think about how you’re contributing to your company as a whole, and the broader impact of its mission. Hopefully, you’ ll find that it’s a great reason to keep going.4. Reach OutSometimes when you feel surrounded by work, it’s because, well, you’re surrounding yourself with work. So, be deliberate about taking time before work, after work, or on your lunch break to step away from the office. Call your significant other, your mom, or your best friend, and ask what’s going on with them, avoiding the temptation to discuss anything even remotely work-related. Your job may be your focus for the rest of the day, but for a few minutes, move it to the backburner and focus on something (anything) else.5. Reward YourselfFinally, even when you don’t get a vacation day, think about other ways you can reward yourself for everything you’ve accomplished. Maybe you’ll treat yourself to frozen yogurt each afternoon, or pick out a new pair of shoes. If you can, plan a quick staycation- a concert, spa day, or even just 45 minutes that you’ll wholeheartedly devote to the new issue of US Weekly by the poo l. Having something to look forward to outside of work can keep you going, and will help ensure that even though you work 9-5 (or, let’s be honest, 8-8), you get at least a little bit of true time off.Unfortunately, burnout happens even to the best of us. And, while a week-long vacation isn’t always in the cards right away, finding simple ways to mix up your routine, reward yourself, and focus on your results can help get you through until then.Photo of burned out woman courtesy of Shutterstock.

Why You Should Quit Your Job to Freelance

Why You Should Quit Your Job to Freelance Why You Should Quit Your Job to Freelance I used to be just like you. My old job as an executive recruiter meant long hours with little to show for my work.  I was working my tail off and making a lot of money for the companies that employed me,  but I wasn’t profiting at all. If you’re like me, that sounds about as appealing as actually eating those proverbial sour grapes. Because I’ve always had a bit of an entrepreneurial spirit, I let it take hold of me. My drive to build something of my own  motivated  me  to go the freelance route.  I  sold my car, moved to a smaller apartment, and cut my bills in half. Everything grew from there. So when I say freelancing  is  a  real, valid job, I’m speaking from experience.   Some people think freelancers aren’t truly employed. They think - or maybe just want to believe - that there’s no way to work from home and make enough money to pay the bills, save for retirement, and have insurance. But that’s not the case. What Makes Freelancing Better Than Corporate Life Several benefits come from freelancing that simply can’t be experienced in a corporate environment, such as having the freedom to turn down bad assignments and collaborate on your own terms. For example, if you’re a freelance copywriter and three projects hit your desk at the same time, you can choose which ones to take and which to turn down. If the first two projects offer great pay, but the third one does not, you can tell the third client, “Sorry, but my plate is too full.” Good luck saying that to your boss in your corporate job. It may seem like you don’t have much human interaction in a freelance setting, but that’s not true, either. Depending on your business, you may work with numerous clients and contractors every day.  You can share an office with someone downtown if you want, and you’re free to mix in lunch dates with your friends.  The freelance lifestyle is sometimes portrayed as lonely, but it most definitely isn’t. These are just a few of the perks of working for yourself that you’ll never experience in a corporate setting. Do some more research to find out whether, for you personally, the  benefits that freelancing can offer  outweigh those provided by more traditional career paths.  The personal and professional benefits can be incredible. If you’re considering taking the freelance path, don’t just dive in headfirst. You need to ask a few questions to determine whether freelancing is right for you: Can I make enough money to survive?  This isn’t Silicon Valley, where you raise millions of dollars for your software idea, then work on it until the money runs out. If you’re considering going out on your own, you should keep your day job while you build up your side business. I know this might not be the advice you want to hear, but it’s practical - and you should take it. Is there a market for my service?  You may be the best  ventriloquist  you know, but can you make enough money performing your skill to consider your act a business? Test the waters by  Googling  the type of service you’re planning to offer. Make the search specific to your area. Talk to potential clients and your friends. Hammer out the details of your idea before taking the plunge. Am I disciplined enough for the freelance lifestyle?  Does working freelance mean sleeping until 11 a.m. and knocking off at 3 p.m.? Unless you’re making an amazing hourly rate, freelancing doesn’t mean sitting around in your pajamas and completing the occasional project. Be prepared to motivate yourself to work hard. Are You Ready to Make the Leap? People get stuck in their ways;  they think you can’t make money online or believe  that the Internet is full of nothing but scammers. But if you know  what to look for  and which resources to use, freelancing opens up a whole world of possibilities. You truly can do full-time work from home and make plenty of  money. However, it’s important to understand that you need to be prepared to work hard.  Freelancing  is a grind.  I left the corporate world because I knew I could do better for myself, not because I wanted an easier job. But don’t let fear or misunderstandings hold you back. Freelancing was, without a doubt, the right path for me - and it could be the best one for you, too. Search freelance jobs with Simply Hired. Melissa Cooper, a freelancer, net entrepreneur, and micro-enterpriser, is author of “Freelance Nation.” Dedicated to career and organizational effectiveness, she’s earned SPHR and PHR designations. Starting with $700 and a VoIP phone, she grew her first company to more than 400 virtual workers, selling it for several million dollars.

Job ambiguity The future and you

Job ambiguity The future and you Job ambiguity The future and you Globalization, advancements in technology and the celerity at which their both occurring present several key challenges for young professionals. A sharp increase in education requirements, for one, has cowed an entire generation into a perpetual pursuit of degrees. Fierce competition is now the only real visible feature of a job market that is becoming increasingly ill-defined. In the meantime, saddled with debt and robbed of time, graduates settle into chronic underemployment. To many the solution is simply a matter of beating the market at its own game â€" adaptability: put in the work to become so valuable, in so many essential ways, you become unfireable.Flexibility is important, but it’s only the first of many necessary steps.I couldn’t tell you the exact number of meditations I’ve read in a panic on the topic of job ambiguity but I could tell you how many I’d recommend.Ellen Ruppel Shell, a correspondent for the Atlantic and author of “The Job: Work and its Future in a Time of Radical Change” attempts to dispel some of the myths that needle the dialectic. Too often the conversation that accompanies career uncertainty is a clumsy sterile one: laborers are afraid of robots and those with sophisticated jobs fear outsourcing.Adapting to a mercurial market can’t exclusively be aided by economic musings because the problem is also a philosophical one.  In her pursuit to definitively define the value of work, Shell finds herself in the company of workers from varied fields â€" uncovering a sobering truth: We’ve collectively abandoned the distinction between good work and meaningful work. The line has been blurred or â€" more accurately, misrepresented.   It’s this breed of misunderstanding that seriously wounds perseverance.  Before we can combat the developing job world of the future we first have to dismantle the stigmas that sicken this one.The college mythMillennials receive a fair share of censure for their desire to find meaning in their w ork. I am deaf to neither the critique or the ache but as Shell establishes, we must be careful not to deter the drive.  There are jobs, careers, and callings.Your source of income isn’t beholden to any of the three but you can find meaning in all of them. It’s a question of attitude â€" perspective. The jobs that merely provide us with a living afford us the liberty to find meaning in other aspects of our lives. If you’re one of the few lucky enough to be compensated for your calling be wary of enabling the job itself to define you.“Don’t be married to the job, be engrossed in the work,” Shell says. Allow flexibility to become the insulation between you and the advancing technological age.  My generation is staffed by a toxic resentment â€" a resentment reared by the college myth. We enter the workforce with its bile coursing through our veins. We want careers that immediately justify all the time and money dissevered from us. Here I recommend some self-reproach. It is quixotic on our part to entrust a degree with the task of procuring a stable living.Shell dissects the falsehood cleanly in a piece published in the New York Times, writing:“If future income was determined mainly by how much education people received, then you would assume that some higher education would be better than none. But this is often not the case.  People who have dropped out of college - about 40 percent of all who attend - earn only a bit more than do people with only a high school education: $38,376 a year versus $35,256. For many, that advantage is barely enough to cover their student loan debt.”Going forward we must inspect our thirst for higher education with vicious scrutiny. Is it an earnest one? Or is it one informed by socioeconomic expectations? One such professional seems to have gotten it right the first time, allowing her to receive the fiscal shrapnel with a welcomed dose of prudence. Brooklyn based essayist  Haylee Millikan,  currently completing a dua l Masters in Creative Publishing and Critical Journalism and Gender and Sexuality Studies at The New School of Social Research, meets job ambiguity with nature’s mirror  and rejects the poetry of squandered time. She cements the long and visible silences between pursuing education or publishing literature by making her creative skills practically useful.I had the pleasure of a brief correspondence, during which she leaped to correct my use of the word “fear” as the author of her hunger for knowledge, stating instead: “I was motivated by the desire to further my knowledge about the things I’m professionally interested in, in a world that requires a certain pace from successful young adults.”“I wanted to be able to back up the organizational and research background I had with a degree. I know from working as a liaison to admissions for both my graduate programs that people look to pursue higher education because they think it offers them more opportunity in a job market that is turning more and more freelance and where companies are expecting employees to be able to juggle many different kinds of work at once at a high caliber,” Millikan told me. “With that being said, there’s value in being an educated person in a falling-apart world and I enjoy being a part of academic communities immensely.”Anecdotes like this one go a long way to defy the antiquated pick-up-your-bootstrap slight that has been hurled at Millennials for the better part of a decade. Millikan â€" a poet, and a battler  â€" imbibed the notion that college was a necessity, absorbed the nutrients then expelled the toxins. Generational solidarity is by far the lowest form (Rip Mr. Hitchens) but the conversation of job ambiguity has permitted it a new life. I ask you to spurn all proclamations that belittle desire for meaning in the workplace and make a point to never abandon the want. The tools to man a vertiginous landscape are forged in the mind.A study published by Medica Xp ress conducted on 800 subjects from a wide range of industries found that workers with positive “attitudes” towards job ambiguity evidenced better leadership skills, lower stress levels and even earned a higher wage on balance than those that didn’t.Unfortunately, as it stands, younger workers were found to be less likely to cope with ambiguity than older ones. In summation of the aim of Ellen Ruppel Shell’s many mediations on the subject, the pertinacity of Millikan’s trajectory and a few beans of my own: Stay calm, be adjustable, develop a thirst for novel challenges, and most importantly be sure to maintain a sense of purpose in either the work you’re doing or the freedom it affords you.On this Millikan adds: “Impact can be measured in a lot of different ways, and what is meaningful to me is certainly not universal.”“But I will say that I’ve always thought about my impact in simultaneously tangible and intangible ways,” Millikan continues. “Some of my work is directly related to helping people and creating resources, and some is calling attention to issues that people may not think they have time to care about. I try to prioritize working for organizations that allow me to fulfill on some level those values, and that’s what is meaningful to me.”Pomp and circumstance isn’t a funeral dirge. Salute the precarious future that awaits you with confidence, caution, and an eager heart.

Information on the Fair Labor Standards Act (FLSA)

Information on the Fair Labor Standards Act (FLSA) Information on the Fair Labor Standards Act (FLSA) The Fair Labor Standards Act (FLSA) is a United States Federal law that was enacted in 1938. It protects workers by setting standards for minimum wage, overtime pay, recordkeeping and youth labor. Who is Covered? This law covers full-time and part-time workers in the private sector and federal, state, and local governments. The law may apply to you because of the type of company or organization for which you work, known as enterprise coverage, or the type of work you perform known as individual coverage. If you are one of two or more employees working for an enterprise, for example, a business or organization, that has annual sales or does business of at least $500,000, you are protected by the FLSA under the provision for enterprise coverage. You are also covered by this law if you work for a school or preschool, a government agency, or a hospital or a business that provides medical or nursing care for residents. Dont work for an enterprise as described above? You may still be protected by the FLSA under individual coverage. If your work regularly involves interstate commerce including producing goods that are shipped out of state, talking by phone to people in other states, handling records of interstate transactions, traveling to another state or even doing janitorial work in a building where goods that will be shipped out-of-state are produced. Domestic service workers are also protected by the FLSA. Minimum Wage All workers, except those who are considered by the FLSA to be exempt, must be paid a national minimum wage established by the US Congress. As of July 24, 2009, that wage is $7.25 per hour. Some states have set their own minimum wage. The employer must pay whichever wage- Federal or state- is higher. Employers may pay workers who receive at least $30 per month in tips a minimum wage of $2.13 an hour. For more information about wages for tipped employees, please see Fact Sheet #15: Tipped Employees Under the Fair Labor Standards Act. Overtime Pay Employers must give overtime pay to non-exempt employees who work over 40 hours per week. They must pay these workers at a rate of at least time and half of their regular rate. For example, if a worker who earns the minimum wage of $7.25 works 44 hours in one week, he or she must be paid for an additional 6 hours of work (1.5 x 4 hours). An employee who must work on a Saturday, Sunday or holiday does not qualify for overtime pay, as long as this schedule does not push one over the limit of 40 hours of work per week. Recordkeeping The FLSA sets standards for the type of information employers must maintain about their workers. They are required to keep records that must contain the following information: Employees full name and social security number.Address, including zip code.Birthdate, if younger than 19.Sex and occupation.Time and day of the week when employees workweek begins.Hours worked each day.Total hours worked each workweek.Basis on which employees wages are paid (i.e., amount per hour, amount per week, amount per item produced)Regular hourly pay rate.Total daily or weekly straight-time earnings.Total overtime earnings for the workweek. All additions to or deductions from the employees wages. Total wages paid each pay period.Date of payment and the pay period covered by the payment. Child Labor Standards Child labor laws protect the rights of those under age 18. These provisions limit the number of hours children may work and what they may do. For more information see Teens and Work: Rules and Regulations. More Details If youd like to learn more about the Fair Labor Standards Act, see Compliance Assistance - The Fair Labor Standards Act (FLSA). Article 15, Accused Demanding a Trial by Court Martial

Article 15, Accused Demanding a Trial by Court Martial Article 15, Accused Demanding a Trial by Court Martial Except in the case of a person attached to or embarked in a vessel, an accused may demand a trial by court-martial in lieu of nonjudicial punishment  (NJP). The key time factor in determining whether or not a person has the right to demand trial is the time of the imposition of the NJP and not the time of the commission of the offense. Prehearing Nonjudicial punishment results from an investigation into unlawful conduct and a subsequent hearing to determine whether and to what extent an accused should be punished. Generally, when a complaint is filed with the commanding officer of an accused (or if that commander receives a report of investigation from a military law enforcement source), that commander is obligated to cause an inquiry to be made to determine the truth of the matter. If, after the preliminary inquiry, the commanding officer determines that disposition by NJP is appropriate, the commanding officer must cause the accused to be given certain advice. The commanding officer need not give the advice personally  but may assign this responsibility to the legal officer or another appropriate person. The following advice must be given, however. Contemplated action. The accused must be informed that the commanding officer is considering the imposition of NJP for the offense(s).Suspected offense. The suspected offense(s) must be described to the accused and such description should include the specific article of the UCMJ which the accused is alleged to have violated.Government evidence. The accused should be advised of the information upon which the allegations are based or told that he may, upon request, examine all available statements and evidence. Right to refuse NJP. Unless the accused is attached to or embarked in a vessel (in which case he has no right to refuse NJP), he should be told of his right to demand trial by court-martial in lieu of NJP; of the maximum punishment which could be imposed at NJP; of the fact that, should he demand trial by court-martial, the charges could be referred for trial by summary, special, or general court-martial; of the fact that he could not be tried at summary court-martial over his objection; and that, at a special or general court-martial, he would have the right to be represented by counsel. Right to confer with independent counsel. United States v. Booker, 5 M.J. 238 (C.M.A. 1977), held that, because an accused who is not attached to or embarked in a vessel has the right to refuse NJP, he must be told of his right to confer with independent counsel regarding his decision to accept or refuse the NJP if the record of that NJP is to be admissible in evidence against him should the accused ever be subsequently tried by court-martial. A failure to properly advise an accused of his right to confer with counsel, or a failure to provide counsel, will not, however, render the imposition of NJP invalid or constitute a ground for appeal. Hearing Rights If the accused does not demand a trial by court-martial within a reasonable time after having been advised of his rights (usually 3 workdays unless the commander grants an extension), or if the right to demand court-martial is not applicable, the accused shall be entitled to appear personally before the commanding officer for the NJP hearing. At such hearing, the accused is entitled to: Be informed of his rights under Art. 31, UCMJ (Self-Incrimination)Be accompanied by a spokesperson provided by, or arranged for, the member, and the proceedings need not be unduly delayed to permit the presence of the spokesperson, nor is he entitled to travel or similar expensesBe informed of the evidence against him relating to the offenseBe allowed to examine all evidence upon which the commanding officer will rely in deciding whether and how much NJP to imposePresent matters in defense, extenuation, and mitigation, orally, in writing, or both Have witnesses present, including those adverse to the accused, upon request, if their statements will be relevant, and if they are reasonably available. A witness is reasonably available if his or her appearance will not require reimbursement by the government, will not unduly delay the proceedings, or, in the case of a military witness, will not necessitate his or her being excused from other important duties, andHave the proceedings open to the public unless the commanding officer determines that the proceedings should be closed for good cause. No special facility arrangements need to be made by the commander. Even if the accused does not wish the proceedings to be open to the public, the commander may open them anyway at his/her own discretion. In most cases, the commander will open them partially  and have present relevant members of the command (XO, first sergeant, supervisor, etc.) The Manual for Courts-Martial provides that, if the accused waives his right to personally appear before the commanding officer, he may choose to submit written matters for consideration by the commanding officer prior to the imposition of NJP. Should the accused make such an election, he should be informed of his right to remain silent and that any matters so submitted may be used against him in a trial by court-martial. Notwithstanding the accuseds expressed desire to waive his right to personally appear at the NJP hearing, he may be ordered to attend the hearing if the officer imposing NJP desires his presence. Normally, the officer who actually holds the NJP hearing is the commanding officer of the accused. Part V, para. 4c, MCM (1998 ed.), allows the commanding officer or officer in charge to delegate his authority to hold the hearing to another officer under extraordinary circumstances. These circumstances are not detailed, but they must be unusual and significant rather than matters of convenience to the commander. This delegation of authority should be in writing and the reasons for it detailed. It must be emphasized that this delegation does not include the authority to impose punishment. At such a hearing, the officer delegated to hold the hearing will receive all evidence, prepare a summarized record of matters considered, and forward the record to the officer having NJP authority. The commanders decision will then be communicated to the accused personally or in writing as soon as practicable. Personal Representative The concept of a personal representative to speak on behalf of the accused at an Article 15, UCMJ, hearing has caused some confusion. The burden of obtaining such a representative is on the accused. As a practical matter, he is free to choose anyone he wants a lawyer or a nonlawyer, an officer or an enlisted person. This freedom of the accused to choose a representative does not obligate the command to provide lawyer counsel, and current regulations do not create a right to lawyer counsel to the extent that such a right exists at court-martial. The accused may be represented by any lawyer who is willing and able to appear at the hearing. While a lawyers workload may preclude the lawyer from appearing, a blanket rule that no lawyers will be available to appear at Article 15 hearings would appear to contravene the spirit if not the letter of the law. It is likewise doubtful that one can lawfully be ordered to represent the accused. It is fair to say that the accused can have anyone who is able and willing to appear on his behalf without cost to the government. While a command does not have to provide a personal representative, it should help the accused obtain the representative he wants. In this connection, if the accused desires a personal representative, he must be allowed a reasonable time to obtain someone. Nonadversarial Proceeding The presence of a personal representative is not meant to create an adversarial proceeding. Rather, the commanding officer is still under an obligation to pursue the truth. In this connection, he/she controls the course of the hearing and should not allow the proceedings to deteriorate into a partisan adversarial atmosphere. Witnesses When the hearing involves controverted questions of fact pertaining to the alleged offenses, witnesses shall be called to testify if they are present on the same ship or base or are otherwise available at no expense to the government. Thus, in a larceny case, if the accused denies he took the money, the witnesses who can testify that he did take the money must be called to testify in person if they are available at no cost to the government. It should be noted, however, that no authority exists to subpoena civilian witnesses for an NJP proceeding. Burden of Proof The commanding officer or officer in charge must decide that the accused committed the offenses(s) by a preponderance of the evidence. Findings After consideration of all the factors, the commander makes his/her findings: a. Dismissal with or without warning. This action normally is taken if the commanding officer is not convinced by the evidence that the accused is guilty of an offense, or decides that no punishment is appropriate in light of his past record and other circumstances. Dismissal, whether with or without a warning, is not considered NJP, nor is it considered an acquittal.b. Referral to a court-martial, or pretrial investigation under  Article 32, UCMJ.c. Postponement of action (pending further investigation or for other good cause, such as a pending trial by civil authorities for the same offenses) d. Imposition of NJP. The Laymans Digital Media Glossary

The Layman's Digital Media Glossary The Layman's Digital Media Glossary Whether you’re considering a digital media-heavy career or just want to brush up on the latest lingo, this digital media glossary is worth a look. Digital media. You’ve heard about it, you’ve talked about it, you may even work in it. But what is “it,” and what are all of those confusing buzzwords that people throw around when discussing digital media. Without further ado, I present:The (un)Official Digital Media Glossary of Terms: An Abridged Layman’s Term Guide to Some of the Most Frequently Used Digital Media Buzzwords.A Ad Serving: The online delivery of an advertisement to an end user’s computer. This is typically done through an Ad Server, and allows an advertiser to track and measure the performance of an ad. Animated GIF: A type of image that combines multiple static images and displays them in order, which gives the appearance of movement. GIFs are internet compatible, making them an ideal alternative to video and flash files which are browser dependent. API: An acronym for Application Programming Interface, which may sound confusing, but is just a fancy name for describing the way in which a computer program talks to another computer program. B Beta: A state of testing a version of a product, such as a website before it launches. Sometimes products in Beta are made public or selectively open to a group of people. It’s like a dress rehearsal- sometimes it has an audience and sometimes its entirely private. Blog: A specific type of website that consists of a series of posts, and displayed, most typically, in reverse chronological order. Sites like Mashable, TMZ and Gawker are among some of the more popular blogs. Bounce Rate: A site metric that describes the percent of people who visited a website and left almost immediately. It’s like showing up at a restaurant, realizing the wait is too long for a table, and leaving without ever sitting down. C Cookie: A delicious dessert. But in the digital media world, a cookie refers to a string of code, embedded in a site, that follows a user around as they browse to help determine their online behavior. Cookies are like invisible GPS trackers that stalk you as you surf the web (in a non-creepy way). CPM: “Cost Per Thousand” (thousand represented as the Roman numeral M). A form of digital media currency, describing the cost for 1,000 impressions (“Impressions” defined under “I”). If a website charges $2,000 per 100,000 impressions, they charge a $20 CPM. Crowdsourcing: Asking a group of people (usually strangers) to perform a task that would normally be handled by one individual/employee. Quora is a great tool for crowdsourcing advice. Kickstarter is a great example of crowdsourcing funding. D Demographic Targeting: A method of showing a specific piece of content (ie: an advertisement), to a group of visitors based on their age, gender or houshold income. DFP: The most popular ad server, DFP is owned by Google, and is used by a vast majority of publishers. Digital Media: Content that can be viewed, distributed, modified and preserved on computers. E E-Commerce: The buying and selling of goods online. Perks is a great example of an e-commerce site. ESP: Email Service Providers allow for the mass distribution of emails by a company. If you subscribe to any newsletters (ie: UrbanDaddy ), you receive the company emails by way of an ESP. Expandable Banner: A type of digital ad that expands in size when a user rolls over or clicks on it. F Flash: A rich media vector-based file format used to display interactive animations/videos on a web page. Flash is a trademarked term, owned by Adobe. Fold: An invisible line on a users screen, separating the top half from the bottom half of a web page. If something is described as being “below the fold,” then it requires a user to scroll on the page to see it. Frequency Capping: The limit of how many times one specific user can see a given advertisement within a given time period. For instance, if I only want my ad to be displayed one time per day for every person that sees it, I can put a frequency cap on it to avoid over-showing it. G Geo-Targeting: Similar to demographic targeting, geo-targeting allows a piece of content (ie: an advertisement), to display only to people within a certain geo-location. Geo-targeting can be as broad (by country) or as granular (by ZIP code) as desired. Geo-Fencing is a related term that refers to geo-targeting on a hyper-granular level (such as a specific street or building). Guerilla Marketing: A term that refers to any unconventional or innovative form of marketing or advertising. Typically guerilla marketing is cheaper than traditional marketing, and is meant to be buzzy and sometimes involves stunts or acts meant to garner a lot of press and attention. H Homepage Takeover: The act of having a single advertiser on the home page of a website. This is typically requested by an advertiser who wants to have 100 percent of the ads on a homepage for a given period of time. House Ads: Refers to self-promotional advertisements that a company runs on their own website. Think of it like a digital #humblebrag. I Iframe: Stands for “Inline Frame” and is a way to embed and display content from another site on a website. Think of an IFrame as a window into another property. Impression: A measure of the number of times an ad or post is seen. Typically ads are bought and sold per thousand (see CPM definition). Insertion Order: (IO) is the physical commitment between an advertiser and a publisher to run ads. IOs typically contain a series of line items that outline the contracted number of impressions and dollars promised between both parties. J Javascript: A computer programming language that is written in text and run on browsers only. Javascript differs from Java, in that Java creates applications that can run on either a browser or on a virtual machine (aka computer). JPEG: A file format that allows for the compression of high quality color images. This is the most popular file format for pictures because it keeps the quality and color intact. K Keyword Targeting: A method of showing a specific piece of content (ie: an advertisement), to a group of visitors based on certain words within a given piece of content. Try searching the word “sneakers” in Google. Google will return a bunch of relevant links (based on that keyword, “sneakers”) and ads (on the right hand side) for sites like Zappos and Nike. Those companies are using keyword targeting and paying to appear next to the word “sneakers.” KPI: A Key Performance Indicator is a fancy term for describing an organization’s goals. In digital media, advertisers typically give publishers a campaign’s “KPI’s” to help ensure that both parties agree on what success looks like. L Link Bait: Is any link posted on a website with the intention of having users click on out to another site. Its name is quite literal â€" it’s like fishing bait, except instead of luring fish using grub, it lures people using links. Location Based Service: Any computer program that uses location data to control features. Sites like Weather.com and OpenTable, and mobile apps like UrbanDaddy’s The Next Move determine where a user is located and return relevant content and/or data. M Metadata: Data about data. That’s such a “meta” definition, I know. But that’s exactly what metadata is â€" descriptions of information. To give you a non-technical analogy, take a book. If you consider the book to contain data, then think about the fact that the book also has an author and a publisher. The name of the author and the name of the publisher are both considered to be metadata, as they are data about data. Microsite: A microsite refers to any separate page of a website that has a separate URL than its homepage, but is related to it in some way. Microsites are commonly used to promote something that is time sensitive such as a contest or sweepstakes. N Navigation Bar: Or “nav bar,” refers to an element on a webpage that contains links to other sections of that site. Typically a nav bar is located at the top of the page, and appears on all pages of a website (not just the homepage). The nav bar can contain categories (as seen on UrbanDaddy ), trending topics (as seen on Mashable ), or CTAs like “shop now.” O Operating System: An operating system is basically like the CEO of your computer. It manages all of the programs on a computer, much like the CEO manages all of the employees at a company. A computer cannot function without an OS. Organic Traffic: Visitors that are referred to a site by way of an unpaid search engine listing. This differs from “Direct Traffic” which accounts for visitors who arrive on a site by typing the URL into their browsers. Overlay: A term used to describe any piece of content (ie: an advertisement or a video) that appears to be floating on top of other content. P Page View: This is simply a page of a website that is viewed by a user. Page views are a website’s metric to see how engaging their site content is. The higher the page views per session, the more deeply engaged the visitors are. Pixel: A practically invisible image that is placed on a website in order to track activity on that site or page. Unlike a cookie, a pixel does not follow a user around once they leave that site or page. PPC: Pay Per Click is the amount spent to get an advertisement clicked. Some advertisers prefer PPC over CPM because it guarantees visitors clicking through to their site (not just seeing the ad). PPC tends to be more expensive, but depending on the advertiser’s desired KPI, could be more valuable. Q Query: As simple as it sounds, a query is literally a question or a request for information made to a database. When you “Google” something, you are making a query. R Rate Card: A document that contains prices and descriptions for a media company’s ad offerings. Think of a rate card like a menu: It contains descriptions of items being offered, with a price tag on each item. Reach: A way to measure a website’s unique audience size against the total internet audience. When talking about reach, the audience is always unduplicated, meaning, if I visit a site more than one time, I would only be counted once (when quantifying reach). Tools like Comscore and Quantcast provide a universal way for all advertisers to compare a site’s reach. Rich Media: A term used to describe advertisements that users can interact with. Any ad that changes as you hover, or allows you to click in it, is considered a form of rich media. Run of Site: (ROS) refers to an advertisement showing up on any page at any time on a website. This is a general bucket term for publishers, and is a very popular media buy. S SEO: Search Engine Optimization is a form of marketing, wherein a website uses best practices to help them achieve a better page ranking in search engine results. SERP: Search Engine Results Page is literally the results page that appears after you enter something into a search engine. Let’s say I search “Cupcakes” in Google. The page that comes back after the search is a SERP. The first website listed is for Baked By Melissa. I can then assume that Baked by Melissa is doing something right with their SEO approach. Single Sign On: Quite literally, single sign on is the ability to sign onto a platform and have access to multiple other properties and systems without having to log in again each time. Have you ever logged into an app that offered the ability to sign up through Facebook? That app is using single sign on. T Third Party Ad Serving: Ads are typically either first-party served or third-party served. First-party served ads are ads being served by the site/publisher displaying the ads. On the other hand, third-party ad serving refers to ads being served by the advertiser (or agency). Third-party ad serving allows advertisers to have a tighter control on the creatives and gives them slightly more visibility into the performance of the ads. Traffic: The number of visitors to a website. U Uniques: The number of individual users visiting a website. UI: (User Interface) is anything that a person interacts with. In the digital media world, this typically refers to the design and layout of a web page, mobile app or any digitalized interaction. The goal of every digital product is to have an intuitive UI, meaning it’s easy for a person to understand and navigate. User Generated Content: (UGC), refers to any form of digital discussion created by users of an online community. Yelp, for instance is a website built entirely on UGC. Many blogs allow for commenting, which is another form of UGC. UX: (User Experience) is a way to describe the interactions that a person has with a digital product. Where UI refers to the look and feel of a digital product, UX refers to the interactions and processes that occur when a user engages with the site. V Viewability: A hot topic in the digital media world right now, viewability refers to the percent of an ad that is “in view” at a given time. Historically, advertisers paid for ad impressions, and until recently were not concerned with whether or not that ad was actually being viewed by a person. Viewability is typically defined by at least 50 percent of an advertisement being on the screen for at least one second. Viralality: The tendency for a piece of digital media content (ie: video, story, image etc) to be circulated rapidly and widely across the internet. The gold and white/blue black dress was an example of an image going viral. W Widget: A small application that lives on a desktop or within a website that offers useful or entertaining information. Have you ever visited a website that had the weather report in a little box on the page? That was most likely a widget. X XML: eXtensible Markup Language is a form of computer programming language that carries information. XML is not an alternative to HTML; it provides a different function. HTML is meant to display data, and XML focuses on describing the data. Y Yield Management: The act of maximizing revenue generated by allowing variable pricing based on consumer behavior. In the digital media world, a yield manager liaises with the finance and ad-ops teams to make sure a publisher is getting the most bang for their buck (or money for their ad space).

Supervisors Does Your Resume Feature Your Strengths

Supervisors Does Your Resume Feature Your Strengths Supervisors Does Your Resume Feature Your Strengths Supervisors: Does Your Resume Feature Your Strengths? I recently attended a Veterans’ Career Fair and took the opportunity to meet with five veterans, all former supervisors.   I learned that they were seeking positions in areas like operations, administration, and communications.   More than that, they expressed a continued to desire to work in a supervisory capacity.   However, when I reviewed their resumes I was stunned to find that none of them featured their supervisory skills.   No mention was made of the types or numbers of employees they supervised.   They did not expound upon the complexity or scope of specific duties.   For those who managed budgets, no dollar figures appeared in their resumes.   The resumes were so generic, so boring, so lacking in detail that I felt compelled to write an article about how to highlight supervisory experience in a resume. As is true with any resume, it is important to be clear and specific about your most important skills and strengths.   If you’re a supervisor, your resume should clearly demonstrate that you possess a supervisory skillset. Here’s a before and after example for a supervisory resume with an emphasis on operations: BEFORE: Manage and develop sales and service staff of nine employees. AFTER: OPERATIONS SUPERVISOR: Manage, schedule and train nine retail bank staff, including tellers, mortgage specialists, administrative and customer liaisons. Recruit and select new personnel based on skills and experience. Train new staff in bank operations, customer services, and administrative policies and procedures. Review performance and recommend additional training as needed. Provide ongoing training and development to improve customer services and quality of performance. Maintain personnel budget by closely managing time and attendance, and staff schedule. Motivate staff with frequent recognitions, performance discussions and events, which have resulted in a high morale and friendly customer services by our staff. Skilled in staff problem-solving and negotiating solutions to performance or attendance problems. ACCOMPLISHMENT: Upon first coming to this branch, I restructured 50% of the staff due to morale, performance and quality assurance problems. Received recognition by Bank of America for outstanding Customer Service. The “before” version is a one-sentence summary that provides no detail; it isn’t even clear if the individual is a supervisor. The “after” paragraph describes a dedicated, dutiful supervisor who likes their job. It clearly demonstrates their supervisory role, expounds on how they manage budgets and personnel, and reflects a dedication to customer service. If you were looking at a resume, which version would you choose? Example: Overseeing Training and Telecommuting Below is another example of what I consider to be a good supervisory section, with an emphasis on overseeing training and telecommuting. SUPERVISOR â€" TRAINING TELECOMMUTING: Supervise a staff of 15 writers who telecommute from sites nation-wide. Review work products, provide regular feedback, and develop and lead webinar training and meetings to create a cohesive approach to staff communications. Created a linkedin group for sharing policies, procedures and problem-solving among the staff. Improved quality of written-works following a comprehensive review of products, timing and customer services. Developed new customer services policies with specific time-lines and a systematic format for the final delivery of the written materials. Communicate individually with each writer to maintain a rapport, answer questions and resolve problems. ACCOMPLISHMENT: Recruited 5 new writers within the last year, who are performing independently for senior level, complex writing projects with 100% customer satisfaction.   Contracted for and designed a Customer Relations Management database to maintain and track customers online. What is your favorite part of supervision? Training, problem-solving, performance improvement, teamwork approach, skills analysis, small meetings, metrics development to analyze productivity, communications, incentives? Whatever your specialization is in supervision, this is what you should feature in your resume. You need to stand out as a unique supervisor who truly cares about developing people and operational performance. Most of the time, managers are supervisors. Your supervisory job responsibilities should be written and described first on your resume. Since managers supervise people to achieve operational objectives. It’s important to state your staffing situation, before you describe all of your other job responsibilities. Managers also oversee daily operations, budgets, various programs and services, provide customer problem-solving, set up new or improved policies and procedures, purchase or contract for new equipment and services, and direct the implementation of information management systems to streamline information and services. In order to achieve all of their job responsibilities, they SUPERVISE PEOPLE who perform the work of the operations. Supervisors are special people. They like their staff, they want to improve their performance and keep their staff coming to work on-time and with a good attitude. If you are a supervisor who can train and develop excellent employees, be clear in your resume and in your job interview. Talk about your ability to supervise, motivate and lead people. This is a major strength and you should be very proud that this is one of your top skills. ** SES Candidates: Dont forget to check out our Black Friday Sale! 30% off SES Services!
